TON App commits to retaining Users’ Personal data for a duration specified by applicable laws and regulations in the Republic of Lithuania and/or this Privacy Policy, not exceeding what is necessary to fulfill the objectives of Data processing. We will keep the information collected from you for a maximum of five (5) years, or shorter if it is no longer needed for providing TON App Services. After this period, we will delete any collected information. Aggregate data and non-personally identifiable information may be utilized in various ways. This type of information does not identify you individually. ### USER RIGHTS
Users of the Website have the following rights: to know what Personal data is being processed and the purposes for that processing; to request the correction or deletion of their Personal data; to request that TON App restrict the processing of their Personal data for legitimate reasons; to lodge a complaint with the State Data Protection Inspectorate regarding unlawful processing of Personal data or data breaches; and to object to the processing of their Personal data when it is intended for direct marketing purposes. Any requests regarding the processing of the User’s data must be submitted in writing to TON App, using the contact details specified in this Privacy Policy (either via email or postal address). Along with the request, the User must provide an identity document or authenticate themselves using acceptable electronic measures, unless the request is made in person where identification is possible. Users have the right to request the deletion of all Personal data held by TON App.
In response to requests pertaining to the right to be forgotten, TON App commits to providing a detailed reply, including justification and/or explanation if it is not possible to exercise this right due to overriding legitimate interests, or guidance on how to proceed if applicable. When a User requests the deletion of their data, TON App will act without undue delay to erase all Personal data if any of the following conditions are met: the Personal data is no longer necessary for the purposes for which it was collected or processed; the User withdraws consent upon which the processing is based and there are no other legal grounds for processing; the User objects to the processing and TON App cannot demonstrate overriding legitimate grounds for continued processing; the Personal data has been unlawfully processed; or the Personal data must be deleted to comply with EU law or the laws of the Republic of Lithuania.
Users have the right to request a restriction on the processing of their Personal data in the following instances: the User contests the accuracy of the Personal data, for a period allowing TON App to verify its accuracy; the processing is unlawful and the User opposes deletion, requesting instead a restriction on its use; TON App no longer needs the Personal data for processing purposes, but the User requires it for the establishment, exercise, or defense of legal claims; or when the User contests processing until it is verified whether TON App’s legitimate grounds override the User’s.
When processing is restricted as outlined above, the affected Personal data may only be processed, apart from storage, with the User’s consent, for legal claims, to protect another person’s rights, or for significant public interest reasons. Upon receiving a User’s request or order, TON App will respond and take action on the request or provide reasons for any refusal within 30 (thirty) days of receipt. If necessary, this timeframe may be extended by an additional 2 (two) months depending on the complexity and volume of requests. In such cases, TON App will inform the User of the extension and the reason for the delay within 30 (thirty) days of receiving the application. TON App may deny a User’s requests if necessary to ensure compliance with its legal obligations, to maintain public order and prevent crimes, or to protect the rights and freedoms of other Users or third parties. Should a User discover unlawful data processing or encounter a dispute with the Data processor, they have the right to contact the State Data Protection Inspectorate for out-of-court dispute resolution at any time, following the procedures outlined on its website.
### USER RIGHTS
The TON App will not share your information with third parties for the purpose of enabling or providing third-party advertising. However, we may disclose your personal data to third parties and our partners in certain situations, including: with your consent to a service provider or partner that complies with our data protection standards; when we have a reasonable belief that disclosure is required by law, such as in response to a subpoena or legal process; and when we believe that sharing your information may help prevent imminent harm to someone. If we are required to share your information due to legal processes, we will notify you so you can challenge it (e.g., by seeking court intervention), unless we are legally prohibited from doing so or we believe that notification may endanger others. GOVERNING LAW
This Privacy Policy and your use of the Website are governed by the laws of Lithuania. The parties agree to first attempt to resolve any disputes through negotiation. If an amicable resolution cannot be reached through negotiation, TON App agrees to submit the dispute to the competent court in Lithuania.### COPYRIGHTS
